1. Conditions for household division
1. Age and civil capacity
Applicants must be over 18 years old and have full capacity for civil conduct. Minors, mentally ill persons, or persons unable to take care of themselves are not allowed to split households.
2. Independent living and financial independence
• Applicants need to have independent housing and provide real estate certificate, homestead use right certificate or legal residence certificate.
• In rural areas, it is necessary to obtain a certificate from the township, village, or group that agrees to household division, and the principle of “one household, one house” must still be met after household division.
3. Changes in marriage or family relationships
• After marriage, the couple can apply for household division; after divorce, one party can apply for household division with the divorce certificate.
• If family members cannot live together due to conflicts, or if children need to apply for homestead independently after getting married, they can apply for household division.
4. Special circumstances
• Only children can split their households after marriage in some areas (such as Guangzhou), but attention must be paid to asset inheritance and homestead use issues.
• In families with many children, at least one child should live in the same household as their parents to inherit the homestead.
2. Materials required for household division
1. Applicant’s written application report.
2. Applicant’s ID card and original household register.
3. Real estate certificate or homestead use right certificate.
4. Marriage certificate, divorce certificate or court judgment (as appropriate).
5. In rural areas, proof that the village group agrees to household division is required.
3. Household division process
1. Submit materials to the police station where your household registration is located.
2. Investigation and verification by the police station field police.
3. After passing the review, receive the new household registration book.
